Terms of service

1. Scope

These terms apply to all orders placed through this online shop, operated by Curly Crab Unipessoal LDA ("Gourmedi", "we"). Consumers within the meaning of EU consumer law are customers who order for purposes outside their trade or profession.

2. Conclusion of contract

The presentation of products in the shop is not a binding offer. By completing the checkout, you place a binding order for the goods in your cart. The contract is concluded when we accept the order by sending an order confirmation e-mail or by dispatching the goods.

3. Prices and payment

All prices include the applicable statutory VAT. Shipping costs are shown separately during checkout and on our shipping information. The payment methods available are shown at checkout. Payment is due upon conclusion of the contract.

4. Delivery

We deliver to the countries listed at checkout. Delivery times and costs are shown at checkout. If an item is unexpectedly unavailable, we will inform you immediately and refund any payments without delay.

5. Retention of title

The goods remain our property until paid in full.

6. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days. Details, exceptions and the model withdrawal form can be found in our withdrawal and refund policy.

7. Warranty

The statutory warranty rights apply. For consumers in the EU, this includes a legal guarantee of conformity of at least two years (three years under Portuguese law for goods purchased from sellers established in Portugal, where applicable).

8. Liability

We are liable without limitation for intent, gross negligence and for injury to life, body or health. For slight negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Statutory liability, including under product liability law, remains unaffected.

9. Applicable law

Portuguese law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the country of your habitual residence remain unaffected.
